Our
initial consultation for personal bankruptcies is no charge. However,
business bankruptcies are normally more complicated and Ms. Palmer has a
reduced fee for her initial consultation. We have an interview questionnaire
which we request you to fill out and bring to your consultation. This helps
the attorney assess your circumstances and recognize what unique problems
might apply to your situation.
If the reason that you’re seeing an attorney is to see whether a bankruptcy
is appropriate for you, you will need to have information concerning your
debts, including names, addresses and balances. You will also need to bring
information concerning your monthly income and budget. You will also need to
tell the attorney what assets you own and what their value is. Once the
attorney has this information, she can assist you in determining if a
bankruptcy would be appropriate for you and if appropriate, what kind,
either a chapter 7 or a chapter 13 is best suited to your needs.
Under the bankruptcy code, there are two forms of bankruptcy which most
people use, Chapter 7 and Chapter 13. A Chapter 7 is a straight liquidation
and for many debtors means that they are not required to pay any monies to
their unsecured creditors. In a Chapter 7 it is possible to keep your home
and your vehicle if you are current in your monthly payments at the time of
your bankruptcy filing and your equity is not above the limit. However,
every case is unique and Ms Palmer cannot advise you as to your specific
needs until she has had an opportunity to review your financial situation
with you.
A Chapter 13 is a wage earner reorganization. In a Chapter 13, you will be
required to make a monthly payment to the Trustee who will then pay your
creditors. Generally speaking, in a Chapter 13, if you are behind in house
or car payments, you will be allowed to “cure” the arrearages and keep your
assets. In a chapter 13, the plan payments can be no less than 36 months and
no greater than sixty months duration.
Whether you should be in a Chapter 7 or a Chapter 13 or seek bankruptcy
relief at all needs to be determined by Ms. Palmer at the initial
consultation. In order to properly address all of the issues and analyze
your financial situation, we have a
questionnaire which we can either fax or
email to you for you to fill out and bring with you to that initial
consultation.
In either event, whether you file a Chapter 7 or Chapter 13, an order called
a discharge must be issued by the court. A discharge is an order that
relieves you of paying certain debts. In a Chapter 7 the discharge normally
occurs within six months of filing and in a Chapter 13, it occurs after all
payments have been paid pursuant to the Chapter 13 plan.
